If I am injured in an accident, due to the negligence of another driver or a business establishment, what should I do?
Immediately obtain appropriate medical treatment including accepting transport by emergency medical services to a local hospital. Obtain as much contact information as possible about witnesses to the occurrence. Follow up as soon as possible with your primary care treating physician or a specialist. Contact an attorney to commence an investigation that includes obtaining photographs, measurements or other evidence.
What is the usual fee arrangement?
Personal injury claims, including claims injury from medical negligence, are handled on a contingent fee basis. There is no attorney’s fee unless there is a recovery on your behalf. The attorney’s fees on most straightforward personal injury claims are governed by statute, which limits attorney fees on a sliding scale basis on recoveries over $300,000. With respect to claims that are resolved for under $300,000 and medical negligence claims or complex, multiparty personal claims, the attorney's fees are 1/3 of the total recovery, plus reimbursement of expenses.
Will I ever have to pay any costs?
In most cases, costs are paid out of any recovery obtained on a client's behalf. In event of a jury verdict in favor of a defendant, a plaintiff may be responsible for certain costs as set forth in a Bill of Costs statute.
Is there any cost for a consultation about my case?
There is no cost to meet with Attorney Price about your situation or to send him records for him to review pertaining to your potential case.
Will I get to meet with an attorney?
Attorney Price is always available to meet with his clients including on Saturdays.
What do I need to investigate a medical malpractice case?
You should obtain as much medical documentation as possible relating to your treatment, and, in addition, you should obtain all medical records from the responsible treating physicians.
If I have a case, what are the fees?
Attorney’s fees in medical malpractice cases are 1/3 of the total recovery whether by verdict or settlement, plus reimbursement of costs.
Is it difficult to get an expert to testify for you in a medical malpractice case?
There are numerous resources available to obtain expert witnesses in medical malpractice cases. In addition, physicians who have written specific medical articles on the treatment at issue and who have assisted in defining the accepted standard of care for the treatment can be consulted.
Is it hard to win a case against a doctor or hospital?
The key factors that affect whether justice can be obtained in a medical negligence claim are:
- strong evidence in the medical record of a deviation from an accepted standard of practice
- credible expert witnesses to testify in support of the claims of negligence
- a plaintiff who makes a sympathetic and credible appearance
- a capable and experienced medical malpractice attorney
If the above factors are present, juries will hold physicians and hospitals responsible for their mistakes and will award fair, just and reasonable damages.
